Your access to and use of ImprintForLess.com is also conditioned on Your acceptance of and compliance with the Privacy Policy of ImprintForLess.com. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. These sales terms and conditions (these “Sales Terms and Conditions”) apply to the purchase and sale of products and services through https://www.ImprintForLess.com/ (the “Website”). These Sales Terms and Conditions are subject to change by Inspirationzorg, Inc. D/B/A Imprintforless.com (“Company,” “we,” or “us”) without prior written notice at any time, in our sole discretion.

2. Custom Product Orders

• Order Placement: When you place a custom product order, you are making an offer to purchase the product as described. We reserve the right to accept or reject any order for any reason.
• Design and Specifications: You are responsible for providing accurate and complete design specifications, including images, text, and other relevant details. We are not responsible for errors or omissions in your provided specifications.
• Proofing and Approval: For custom products, we will always provide you with a digital proof for your approval. You are responsible for carefully reviewing and approving the proof before production begins. Once approved, changes may not be possible.
• Production Time: Custom product production times may vary. Actual production time will depend on time required for art preparation and approval by you the customer, quantity purchased, number of imprint colors, number of different items being purchased, etc. During certain times of the year production time can also be longer. As a general rule, most 1-color imprint orders are shipped within 5-10 working days and most multi color orders are shipped within 10-12 working days.
• Variations: Due to the nature of custom manufacturing, slight variations in color, size, and finish may occur. These variations are considered acceptable and are not grounds for returns or refunds.
• Drinkware Finishes: Due to the handcrafted nature of our mugs and the manufacturing of our glassware, some variations are normal. All mugs are finished by hand and the color shade and glaze (including the inside glaze color) may vary within the same order or from previously accepted random sample, previous order, pre-production sample or speculative sample. Slight imperfections, minor indentations (pinholes and/or dark dots), unevenness in the glaze and variations in height and diameter must be accepted and are within the industry standard. All our Glassware comes from the world leaders in glass manufacturing, yet small imperfections such as small air bubbles or settle lines can occur in glassware as a result from liquid glass flow. Stainless Steel and Aluminum Travel mugs or Water Bottles colored spray coatings can vary in shade from previously accepted random sample, order run, pre-production sample or speculative sample or within the same order shipment. Capacities listed for wares are approximate and may vary from lot to lot or within the same order. As per industry standards capacities are measured to point of overflow. Some glassware styles have seams due to the manufacturing process. Any of these imperfections are within industry standards and not defects.
• Color Registration:  Color registration refers to the alignment of multiple ink colors in the printing process. Where 2 or more colors are close together there is the possibility of misregistration of approx. 1/32″ of each color in any direction. This is within the industry standard and can vary depending on the product, materials, and printing methods used.
  
• Color Matching: Due to ink variations across different products, a 100% PMS match is not guaranteed. While we will make every effort to match your color, color matching may vary from previous samples or orders. PMS colors shown in our color palettes are approximations. Colors may vary across different monitors, printers, and devices, and the final appearance can also differ depending on the specific item.
• Product Care:

  Product Care: All glassware, ceramic, and porcelain items are kiln-fired at temperatures up to 1200°F. All our glassware, ceramics and porcelain are dishwasher safe. The imprints are designed to be long-lasting and safe with reasonable home or office use. To preserve the longevity of the imprints, avoid the use of commercial detergents and abrasive cleaners, as these can cause damage to any imprint. All plastic and sport bottles are intended for hand washing only. Due to the demands of restaurant environments, our products are not recommended for such use. Damage to imprints or products resulting from misuse, including but not limited to the use of abrasive cleaners, improper washing, or use in a restaurant environment, is the sole responsibility of the client. Imprintforless.com shall not be held liable for any damage resulting from such misuse.

3. Payment and Pricing

• Pricing: All prices are listed in US dollar and are subject to change without notice.
• Payment: Payment is required at the time of order placement. We accept MasterCard, Visa, American Express, Discover and PayPal.
• Taxes: You are responsible for all applicable taxes, including sales tax, VAT, and other duties.
• Customs and Duties: For orders shipping outside the US, local duties, tariffs and taxes may be assessed upon delivery. These fees are not charged by imprintforless.com during checkout; therefore, please consult your local customs office to determine these charges. We are not responsible for any duties, tariffs or taxes on international shipments.

4. Shipping and Delivery

• Shipping: We will ship your custom product to the address you provide at checkout.
• Shipping Costs: Shipping costs are calculated based on the product, shipping method, and destination.
• Delayed Shipping: While we understand that shipping delays can be frustrating, imprintforless.com is not responsible for delays caused by the shipping carrier, inclement weather or other issues outside our control. However, we will do our best to assist you in tracking your package and communicating with the carrier to resolve any issues. If your order is significantly delayed, please contact our customer service team, and we will work with you to find a solution within our policy. 
• Risk of Loss: The risk of loss or damage to the product passes to you upon delivery to the shipping carrier.

5. Intellectual Property

• User Responsibility: You are solely responsible for ensuring that you have the necessary rights and permissions to use any artwork, logos, trademarks, designs, or other intellectual property and (“Content”) you upload or provide for custom product orders. 
• You will assume complete responsibility to obtain permission for reproduction of logos, patents, trademarks and copyrights. By agreeing to print any submitted artwork, Imprintforless.com will not be held liable under any circumstances.
• No Infringement: You represent and warrant that your Content does not infringe upon the intellectual property rights of any third party.
• Intellectual Property Ownership: You retain ownership of your Content, but you grant imprintforless.com a non-exclusive, royalty-free license to use, reproduce, modify, and display your Content for the sole purpose of fulfilling your order.
• No Liability for Infringement: imprintforless.com will not be held liable for any intellectual property infringement arising from your use of Content that you do not have the right to use. We are a custom printing service and are acting on the assumption that the customer has the right to use any uploaded content.
• Indemnification: You agree to indemnify and hold harmless imprintforless.com, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including attorneys’ fees) arising from any intellectual property infringement related to your Content.  
• Content Removal: We reserve the right to refuse to produce any custom product that we believe may infringe upon the intellectual property rights of a third party. We also reserve the right to remove any content from our site that is alleged to be infringing.
• Limitation: In no event shall ImprintForLess.com be liable for any direct, indirect, incidental, consequential, or punitive damages, including but not limited to damages for intellectual property infringement, arising from your use of imprintforless.com or your purchase of custom products.  
• Maximum Liability: Our maximum liability to you for any claim arising from your use of this Website or your purchase of custom products shall be limited to the amount you paid for the product.

6. Returns and Refunds

• Returns on Custom Products: Due to the personalized nature of custom-made products, and in accordance with industry standards, returns and refunds are not offered for customized items. Blank, not customized, products are returnable if the return is made within seven days of order receipt.  For blank returned products, we will issue a refund for the items purchased provided they are returned to us unused and in their original condition. You are responsible for all shipping and handling charges on returned items, along with a restocking fee. Please contact us at imprintforless.com for instructions on returns of blank items. For customized products,  returns or replacements will be provided under the following circumstances:
  • • If imprintforless.com makes an error in customization, and the final product deviates significantly from the approved proof with respect to text, colors, or personalized elements.

    • If you receive a product that is different from what was ordered and shown in the approved proof.

    • If the custom product has a significant manufacturing defect that was not present in the approved design and proof.

• Damaged Products: If you receive a damaged product, please contact us within 10 days of delivery with photos and a description of the damage. We will review your claim and file a claim with the shipping carrier. If approved, we will provide a replacement or refund.
• Claims and Redo:
  Please check your order immediately upon receipt. All claims must be reported within 7 calendar days upon receipt of goods. All claims will be confirmed via email. We may request pictures to be emailed or an actual sample made available for our inspection. If you are dissatisfied due to a product defect, if the item is not as promised, or if the imprint quality is substandard, please contact us at support@imprintforless.com. We will work to find a resolution, such as reprinting your order or providing a refund should such an issue arise.Once we have evaluated the claim we will promptly credit or replace the product if warranted. We will not change the product, the logo or artwork or the imprint color when processing the redo. 
• Cancellation: Custom product orders cannot be cancelled once the digital proof has been approved and production has begun.
• Cancel before proof: If you cancel before proof creation, you will receive a full refund less a 2.2% credit card processing fee.
• Cancel after proof creation: If you cancel after proof creation, you will receive a refund less a $25 fee and the 2.2% credit card fee.
• Please note: Once the order enters the production floor, it cannot be cancelled.

7. Limitation of Liability

• California Proposition 65 Warning: According to California law Proposition 65, all items sold to California must carry a warning label. The State of California requires that no person in the course of doing business shall knowingly and intentionally expose any individual to a chemical known to the State of California to cause cancer or reproductive toxicity without first giving a clear and reasonable warning. Accordingly, if you, the buyer, fails to provide imprintforless.com advance written notice that an imprintforless.com product will be shipped to the State of California, you, the buyer, hereby indemnify and agree to defend and hold harmless imprintforless.com from and against any and all Proposition 65, personal injury and property damage claims, and from all other costs, liabilities, damages and expenses (including, without limitation, attorneys fees and litigation expenses on account thereof or in connection with any investigation or preparation related thereto or the enforcement of this provision) relating to, resulting from, connected with or arising out of goods or products provided to you, the buyer, by imprintforless.com, to the maximum extent permitted by law. Please note that all orders placed with or received from imprintforless.com shall be deemed effective acceptance of these terms.

These Terms shall be governed by and construed in accordance with the laws of New York, United States. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New York, United States.
